Mom sues New York City hospital after she fell on sidewalk while in labor with twins


Mother who broke her collarbone when she tripped on uneven sidewalk outside ER in New York City while in labor with her premature twins sues the hospital

  • Victoria Mellin has sued the NYU Langone Hospital on east side of Manhattan
  • She went into labor June 25 and on her way to hospital she tripped on sidewalk

A mother has sued a New York City hospital after she broke her collarbone while walking on uneven sidewalk toward the emergency room while in labor with her twin daughters. 

Surveillance footage from outside the NYC Langone Hospital on Manhattan’s east side shows Victoria Mellin walking with her husband outside the ER on June 25. 

Within a matter of seconds, Mellin is seen tripping over the sidewalk and crashing to the ground.

Her husband immediately dropped everything he was carrying and rushing over to see if she was hurt. Mellin said she landed on her shoulder while trying to protect her stomach

Her husband immediately dropped everything he was carrying and rushed over to see if she was hurt. 

Mellin told NBC that she landed on her shoulder while trying to protect her stomach. 

‘The motherly instinct immediately kicked in, I tried to shield my abdomen as I was launched forward, rolling onto my shoulder,’ Mellin said. 

During the fall, her collarbone snapped upon impact.

And despite the injury, she still had to give birth to her premature daughters who weren’t due for another six weeks.  

According to NBC, Mellin’s daughters Astrid and Michon were born nine minutes apart.

NYU has denied any wrongdoing and stated that 'all risks, hazards, defects and dangers alleged were of an open, obvious and apparent nature and inherently trivial and were known or should have been known to plaintiff'. This image shows where the incident occurred

Mellin said after the twins were born, they were placed in the neonatal ICU and she had to have surgery on her collarbone. 

‘Those weeks immediately following the surgery were incredibly painful,’ Mellin said. ‘Not being able to be the mother I wanted to be.’ 

Mellin has now filed a negligence lawsuit against the hospital for the uneven sidewalk.  

‘I don’t think every sidewalk in New York has to be perfect, but the sidewalk going into a hospital – the hospital, of all places, they should know that their sidewalk should really be pristine,’ her attorney, Matthew Haicken, told NBC. 

Haicken also shared images that show the uneven pavement where the incident is said to have occurred.  

NYU has denied any wrongdoing and stated that ‘all risks, hazards, defects and dangers alleged were of an open, obvious and apparent nature and inherently trivial and were known or should have been known to plaintiff’.

It’s unclear how much in damages the family is seeking.
